Welcome to Sidhu Contractors Inc. These Terms and Conditions govern the provision of all exterior home improvement services, including seamless eavestrough installation, gutter repairs, CSR preventative maintenance, and siding services provided across the Greater Toronto Area (GTA) and surrounding regions of Ontario. By accepting a quote or authorizing work from Sidhu Contractors Inc., the Client agrees to the following legally binding terms.

Scope of Work & Authorizations

Sidhu Contractors Inc. agrees to provide the exterior services explicitly outlined in the written estimate or invoice. The Client confirms they have the legal authority to authorize work on the specified property. Any additional work requested outside of the original scope will require a separate agreement and may incur additional costs.

Warranties & Limitation of Liability on Repairs

At Sidhu Contractors Inc., we pride ourselves on delivering premium workmanship for full seamless eavestrough installations. However, due to the unpredictability of integrating new materials with existing or aged infrastructure, the following legal limitations apply:

• Repairs & Partial Replacements: Sidhu Contractors Inc. provides no workmanship guarantee or warranty on partial eavestrough repairs, downspout replacements, or localized leak sealing. Fixing one section of an existing system does not guarantee the integrity or future performance of the remaining old system.
• Pre-Existing Conditions: We assume no liability for water damage, foundation leaks, or structural rot caused by the pre-existing state of the home’s fascia, roofline, or original gutter system prior to our arrival.

Third-Party Materials & Gutter Guards

Sidhu Contractors Inc. utilizes premium materials sourced from trusted industry manufacturers.

• Manufacturer Warranties: Any warranty on physical materials, including aluminum downspouts, brackets, sealants, and leaf or gutter guards, is strictly limited to the warranty provided by the original third-party manufacturer.
• Gutter Guard Performance: Sidhu Contractors Inc. does not guarantee the performance, self-cleaning ability, or winter weather resistance (including ice dams) of third-party leaf guards. Our liability is strictly limited to the professional installation of these products, not their ongoing functionality against heavy environmental debris.

Custom Materials Policy

Our seamless eavestroughs are custom-fabricated directly on-site to the exact measurements of your property. Once the aluminum has been run through our machine and cut to fit your home, it cannot be reused or returned. Therefore, any changes to color selections, lengths, or profile styles must be finalized and approved in writing before our truck and trailer arrive on-site.

Unforeseen Structural Damage

Our initial estimates are based on a visual inspection of your home’s exterior. Occasionally, upon removing old eavestroughs or siding, we uncover hidden issues such as rotten wood fascia boards, deteriorated soffits, or severe pest damage. If we discover pre-existing structural damage that prevents a safe and durable installation, we will immediately halt work and document the issue. We will not cover up rot with new materials. A revised action plan and quote for carpentry or structural repairs will be provided before work resumes.

Weather Delays, Cancellations & Rescheduling

Exterior contracting in Ontario is heavily dependent on the weather. The safety of our crew and the quality of our workmanship are our top priorities.

• Weather Delays: We will not perform roof-level work, installations, or CSR maintenance during heavy rain, high winds, lightning, or severe ice conditions. Sidhu Contractors Inc. reserves the right to pause or reschedule your project without penalty in the event of unsafe weather.
• Cancellations: We require a minimum of 48 hours’ notice prior to your scheduled start date for any cancellations or rescheduling. Last-minute cancellations disrupt scheduling and may be subject to a rescheduling fee.

Property Access & Worksite Safety

The Client agrees to provide clear, unobstructed access to the property perimeter.

• Site Preparation: Please ensure driveways are clear of vehicles so we can safely park our truck and equipment trailer. Remove patio furniture, potted plants, and fragile items from the areas where our extension ladders will be placed.
• Safety & Minor Disruptions: Keep children and pets indoors while our crew is actively working. While we take the utmost care, Sidhu Contractors Inc. is not liable for minor, unavoidable disruptions to landscaping, grass, or driveways that occur during the normal execution of heavy exterior contracting work.

Payment Terms & Default

Unless a different payment schedule is outlined in your official quote, payment is due in full immediately upon the completion and final inspection of the work. Under Ontario law, Sidhu Contractors Inc. reserves the right to register a construction lien against the property under the Construction Act, R.S.O. 1990 for any severely delinquent or unpaid accounts to recover the cost of labor and materials.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising from these terms or the services provided shall be resolved exclusively in the provincial courts located within Ontario.
